   Buyer: "The clothes will be out of season"

In this "Double 11", China News Network observed on a shopping platform that women's clothing stores with a pre-sale period of 7 days, 15 days or even 30 days are everywhere.

Recently, she bought a piece of clothes from a platform at sunset. The merchant promised to deliver the clothes within 15 days of the pre-sale period, and gave a latest delivery date. Unexpectedly, the waiting time was nearly a month, which was the result of her constant pursuit of the store's customer service. When the clothes arrived, I found that they were no longer suitable for the current weather.

"Online shopping is just for convenience. The arrival of pre-sale clothes will be out of season. What's the meaning of online shopping?" Although pre-sale has to wait, she believes that merchants and consumers can reach an agreement and deliver goods within the pre-sale period, but she can't bear the infinite delay in delivery of pre-sale goods. She then complained to the customer service of a platform. After a complicated complaint process, the platform compensated her a certain amount.

As at sunset, during the "Double 11", many consumers chose not to tolerate the long pre-sale period and began to question shopping platforms and businesses.

Chuchu, who likes online shopping, suffers from the inconvenience of delayed arrival. "The down jacket bought in winter is received in spring, the cardigan bought in spring is received in summer, the dress bought in summer is received in autumn, and the windbreaker bought in autumn is received in winter." These were the daily experiences of Chuchu online shopping. Recently, it was clearly discovered that if a merchant fails to deliver goods within the specified delivery time, the system will automatically complain if the seller fails to deliver goods within 24 hours by using the expediting function of a platform, and the consumer can get 10% of the price of the goods.

"Although it is not easy to do business, it is hoped that the platform can be rectified for businesses that do not weave until consumers have paid for it," Chuchu said.

In addition, some buyers said that they bought the pre-sale goods when they thought they were in stock, and did not ship them for a long time after payment. After expediting the delivery, the merchant will change the logistics status to shipped. In fact, the goods are waiting for collection for a long time, that is, false delivery.

   Merchants: "Don't dare blindly overstock"

Why is a long pre-sale period set? Chinanews contacted two women's clothing stores and gave different reasons.

Zhongxin first contacted a purchasing shop with a shopping platform as the sales channel, and the goods in the shop were generally set with a 30 day pre-sale period. Although a long pre-sale period was indicated, the customer service of the store said that it was unable to give a clear delivery time.

The customer service said that the goods without standard stock should be purchased on behalf of the shopkeeper. The shopkeeper should go to the counter to purchase or place an order on an overseas website. Generally speaking, the purchase time is 3-28 days. After the purchase, the customer will deliver the goods to the customer. If the goods are out of stock, the customer will apply to the brand for goods transfer. This is why it is impossible to give a clear delivery time and may make the customer wait for a long time. The customer service also mentioned that there is no guarantee that the goods can be purchased on behalf of others. If the goods are not transferred successfully, a refund will be made.

As for the domestic finished clothing, the staff of an online women's clothing store told chinanews. com that the merchants did not dare to blindly stock up now, and the clothes pre-sale in the store really had not been done, because they were not sure whether the clothes would sell well. After the customer places an order, the store will place an order according to the "data" of this dress.

The staff member said that, generally speaking, after the first batch of pre-sales, a certain type of clothes will not be pre-sales later, and will gradually catch up with the supply.

As for the guess of netizens that "take the money of consumers to make clothes", the staff member said that the money of consumers to buy goods would enter the platform first, and the merchants could get the money after the consumers confirmed the receipt of goods. There was no case of making clothes with the money of pre-sales.

   Platform: "Do not force pre-sale period setting"

For the pre-sale period of online goods, China News Network consulted the customer service of a shopping platform. The customer service said that the platform did not stipulate the pre-sale period set by merchants. As long as merchants and consumers reach an agreement, transactions can be made, and the platform is generally not mandatory. If a commodity is clearly marked as a pre-sale commodity, the delivery time shall be based on the pre-sale period. If there is no mark, the platform regulations shall prevail.

The customer service also said that if the system judged that the merchant delivered goods overtime or falsely, it would compensate according to a certain proportion of the commodity price. The longer the delay, the higher the amount of claims, up to 30%.

In this regard, Xia Hailong, a lawyer from Shanghai Shenlun Law Firm, said that the pre-sale period and delivery are related to the major interests of consumers. The first thing that businesses should do is to clearly mark the price of goods, especially the preferential discounts and related conditions that consumers can enjoy, and should inform consumers of key information such as pre-sale period and delivery time in advance, so as to fully protect consumers' right to know and free choice.

Xia Hailong pointed out that it is a breach of contract if a merchant does not deliver goods beyond the pre-sale period or tampers with the logistics status. Consumers can ask the merchant to deliver goods in time or ask for a refund, and require the merchant to pay reasonable liquidated damages. If the merchant is not able to deal with the problem, it can also directly contact the platform customer service to claim compensation according to the platform's commitment to consumers.

As for the platform, Xia Hailong said that it should strengthen the supervision of merchants and supervise them to fulfill user commitments, such as ensuring the independence and security of consumers' prepaid funds, and responding to consumers' rights protection claims through timely refund, payment of liquidated damages and other means in case of breach of contract by merchants.
